1. Personal Information Collection.
We collect information through our Services that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, such as a name, postal address, email address, telephone number, and/or payment information (“Personal Information”). We collect Personal Information when you provide it to us; automatically through the Services, such as through cookies and other online tracking technologies; and from our vendors and other parties that help us operate the Services. The types of Personal Information we collect depend on the nature of your interactions with us and may include:
- Identifiers and personal records, including individual and/or business contact and identification information, such as name, email address, postal address, phone number, and shipping address.
- Commercial information, including records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Financial information, including credit card and other billing information.
- Internet or other electronic network activity information, including device information, such as IP address, device identifier, browser information, operating system, language information; browsing history; search history; and information regarding interaction with the Services and advertisements, such as entries into forms and keystrokes, URL accessed, and dates and times of activity.
- Geolocation information, including as derived from your IP address.
- Professional or employment-related information, including company and job title; work authorization status; resume, CV, cover letter, work experience, and education information; professional and work-related licenses, permits, and certifications held; reference-related information; and any other information that is publicly available or that you elect to provide to us (e.g., current salary, expected salary).
We may combine this information with information about you that we acquire from other sources, including our marketing partners and third parties.
2. Personal Information Use.
We or our vendors may use your Personal Information to:
- Register, administer, and manage your account.
- Sign you up for special offers, from us or our partners.
- Communicate with you, including regarding your requests.
- Process your payment information.
- Provide our products and service offerings to you.
- Personalize your experience with our products and services, including relating to advertisements, and your experience with our Website.
- Improve and enhance our products and services, including enhance the operation of our Services, and obtain feedback regarding your experience.
- Advertise and market our products and service offerings to you, including but not limited to through email, newsletters, text messages, and targeted online advertisements.
- Perform internal business purposes, such as audits.
- Resolve disputes; comply with legal requirements; assert or defend legal claims; troubleshoot problems; and enforce our agreements with you, including our Websites’ Terms of Use and this Privacy Policy.
3. Personal Information Disclosure.
We may disclose Personal Information that we collect or you provide as described in this policy or in one of the following circumstances:
- To our subsidiaries and affiliates, for our business operations.
- To contractors, service providers, and other parties we use to support our business and offer the Services.
- To marketing and advertising technology partners that help us analyze usage, market, and otherwise advertise, including effectuating targeting advertising and promotions based on your use of our Websites and other websites. These third parties may obtain information from Cookies (defined below) on our and other sites. Please note that we do not sell, share, or otherwise disclose Personal Information obtained for text message program consent purposes (opt-in consent data) to any third parties for those third parties’ own marketing purposes.
- To third parties to market their products or services to you if you have not opted out of these disclosures.
- To fulfill the purpose for which you provide it, such as in providing the Services.
- To comply with any court order, law, or legal process, including responding to any government or regulatory request.
- To enforce or apply our Terms of Use or Terms of Sale and other agreements, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.
- As directed by you.
4. Cookies and Other Online Tracking Technologies.
We and our vendors use cookies, web beacons, and other online tracking technologies (“Cookies”), to personalize your experience, update and improve the Services, send you advertising and marketing materials, understand your interests, comply and fulfill your requests, monitor usage metrics, store and remember your passwords, link information to your account regarding your company, if any, and store account and advertising-related information and preferences.
You may refuse to accept browser Cookies by activating the appropriate settings on your browser, or to notify you when you are sent a Cookie so that you may decide whether or not to accept it. However, if you select this setting, you may be unable to access certain parts of our Websites.
In certain instances, we may contract with service providers, such as Mouseflow, to help us analyze activity on our Services and our chat functionality, as applicable, through session replay technologies to help us understand and analyze how visitors use our Services, and to improve the Services. These technologies may collect the following types of information, among others: IP address; screen size; device type (unique device identifiers); browser information; geographic location; and preferred language.
We may use web analytics services, including Google Analytics, to collect information regarding your behavior, demographics, and geolocation or to help us to better develop Website Content and understand how visitors use our Services. We use this information to implement Google advertising features such as dynamic remarketing, interest-based advertising, audience targeting, behavioral reporting, demographics and interests reporting, user segment analysis, device reporting, display advertising, and impression reporting. We and our vendors may also collect information about your use of the Services and other online activities over time and different devices and websites, which may be used for various purposes such as to associate different devices you use, and to deliver relevant and retargeted content, including interest-based advertising. We may link information collected by Cookies to other information collected about you.
Our Websites are not configured to detect Do Not Track signals from a user’s computer, and we do not respond to Do Not Track signals.
5. Interactive Features.
We may engage vendors to provide certain interactive features on our Services. Your use of these interactive features is voluntary, and we may retain the information that you submit through these features. For example, we may offer an interactive chat feature on our Services to answer questions and for other customer service purposes. When you participate in the interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information obtained through the feature to provide the service on our behalf.
6. User Choices.
Personal Information. You may review and edit certain Personal Information by signing in to your account.
Promotional Emails. If you do not want to receive email solicitations from us, you can opt out by accessing your account online and editing your account information to no longer receive such offers and mailings, or by following the instructions in the promotional email. We may continue to send you non-promotional emails, such as emails regarding your orders and other business transactions with us.
Cookies. You also have choices with respect to Cookies, as described above. By modifying your browser preferences, you have the choice to accept all Cookies, to be notified when a Cookie is set, or to reject all Cookies. If you choose to reject all Cookies some parts of our Websites may not work properly.
7. U.S. State Privacy Notice.
This U.S. State Privacy Notice (“Notice”) section supplements the Privacy Policy and describes how Company processes Personal Information in states with comprehensive consumer privacy laws (the “Applicable States”), including the California Consumer Privacy Act (“CCPA”). In the event of a conflict between any other policy, statement, or notice and this Notice, this Notice will prevail as to consumers who are residents of an Applicable State (“Consumers”). This Notice describes our collection, use, disclosure, and sale of Consumers’ Personal Information, as well as rights Consumers may have under Applicable State privacy laws. Terms defined in the Applicable State laws that are used in this Notice shall have the same meaning as in the Applicable State law.
Collection and Use of Personal Information
In addition to the Personal Information set out in the Personal Information Collection section above, we collect the following categories of Personal Information about Consumers:
- Audio, electronic, visual, or similar information, including audio recordings of customer service calls.
- Personal Information described in Cal. Civ. Code § 1798.80(e), including name, signature, address, telephone number, driver’s license or state identification card number, education and employment information, employment history, bank account number, credit card number, debit card number, or other financial information.
- Inferences from Personal Information collected, including customer profiles reflecting preferences and predispositions.
Personal Information we collect about you may vary depending on the nature of your interactions with us and may not include all of the examples listed above.
Some Personal Information we collect may be considered sensitive under certain Applicable State laws and the scope of sensitive Personal Information changes depending on the Applicable State law. We process sensitive Personal Information including: financial information; and an account login, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account.
We use and disclose the categories of Personal Information identified above as set out in the Personal Information Use and Personal Information Disclosure sections above. In addition, we may collect, use, and disclose your Personal Information as required or permitted by Applicable State law. We do not treat deidentified data or aggregate Consumer information as Personal Information, as permitted by Applicable State law, and we reserve the right to convert, or permit others to convert, your Personal Information into deidentified data or aggregate Consumer information. We do not attempt to re-identify such information.
Retention of Personal Information
We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:
- The Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the Personal Information.
- The Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected.
- The Personal Information is reasonably required to protect or defend our rights or property.
- We are otherwise required or permitted to keep the Personal Information by applicable laws or regulations.
Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires.
Sales and Sharing for Targeted Advertising
We may share your Personal Information for cross-context behavioral advertising or targeted advertising (“Targeted Advertising”). Although we do not sell Personal Information in exchange for monetary compensation, some of the ways in which we disclose Personal Information for Targeted Adverting may be considered “sales” in some Applicable States.
We disclose the following categories of Personal Information about Consumers with our advertising partners, analytics companies, and social networks for Targeted Advertising in order to enhance our ability to serve you content and advertisements that may be of interest to you: identifiers and personal records, internet or other electronic network activity information, geolocation information, commercial information, internet or other electronic network activity information, and inferences. As further described in the Cookies and Other Online Tracking Technologies section above, we and our vendors use Targeted Advertising for marketing, advertising, certain types of analytics, or similar purposes and to show you relevant ads while you browse the internet or use social media.
Consumer Privacy Rights
Consumers have rights related to your Personal Information. Certain rights may not be available in your state.
Rights to Confirm, Access, and Know. You may have the right to confirm whether we are processing your Personal Information, to know what Personal Information we have collected about you, to obtain certain details about the Personal Information we process about you, and to access your Personal Information.
Right to Obtain List of Third Parties. You may have the right to request information about third parties to which we have disclosed Personal Information.
Right to Data Portability. You may have the right to obtain a copy of your Personal Information in a portable format.
Right to Correct. You may have the right to request that we correct inaccuracies in your Personal Information.
Right to Delete. You have the right to request that we delete your Personal Information, subject to certain exceptions.
Right to Opt Out of Sales and Sharing of Personal Information for Targeted Advertising. You may have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for Targeted Advertising. If you choose to use the Global Privacy Control (GPC) browser signal, you will only be opted out of online sales and sharing for Targeted Advertising and will need to turn it on for each browser you use.
Rights Related to Profiling and Automated Decision-Making. You may have the right to opt out of the use of your Personal Information for certain automated decision-making, including profiling, in furtherance of decisions that produce legal or similarly significant effects. We do not use Personal Information for automated decision-making, including profiling, in furtherance of decisions that produce legal or similarly significant effects concerning Consumers.
Right to Appeal. Sometimes we are unable to process requests relating to your Personal Information, in which case, your request will be denied. If you are a resident of certain Applicable States whose privacy rights request has previously been denied by us and you believe we denied it in error, you may appeal for reconsideration of your request.
We will not discriminate against you if you choose to exercise any of your privacy rights.
Submitting Privacy Rights Requests
Your privacy rights may be exercised independently or, in certain Applicable States, through an authorized agent.
To exercise your rights to opt out of sales and sharing for Targeted Advertising, manage your Cookie settings through your browser as described in the Cookies and Other Online Tracking Technologies section above. To exercise your other privacy rights, please email us at privacy@customtruck.com or call us toll-free at 844-403-613. These rights requests may be subject to an identification and verification process and, as required by Applicable State law, we will not fulfill a request unless we have been received sufficient information for us to reasonably verify that the requestor is the Consumer about whom we collected Personal Information. We will take appropriate steps to confirm identity for purposes of verifying the authenticity of the request. You may be required to provide certain Personal Information to allow us to verify that you are the Consumer about whom the request is being made or the authorized agent of such Consumer.
Please note that if you make a privacy rights request, we will retain the Personal Information submitted in connection with your request for recordkeeping purposes.
Additional California Disclosures
The information in this Privacy Policy that describes how and why we collect, use, and disclose your Personal Information also describes how we have collected, used, and disclosed Personal Information in the preceding twelve (12) months.
Sales and Sharing
We do not knowingly sell or share the Personal Information of minors under 16 years of age.
Right to Limit Use and Disclosure of Sensitive Personal Information
We do not use or disclose sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the California Consumer Privacy Act.
California’s Shine the Light Law
California Civil Code Section 1798.83, also known as “Shine the Light” law, permits California residents to annually request information regarding the disclosure of your Personal Information (if any) to third parties for the third parties’ direct marketing purposes in the preceding calendar year. We do not share Personal Information with third parties for the third parties’ direct marketing purposes. Please note that we are only required to respond to one request per customer each year, and that you must exercise your California Consumer Privacy Act and Shine the Light rights separately.

Despite our efforts, we cannot guarantee that Personal Information may not be accessed, disclosed, or altered by breach of our safeguards. We urge you to take adequate precautions to protect your Personal Information.
10. Children.
The Websites are not directed at, or intended for use by, persons under the age of 18. If we become aware that we have received Personal Information from a person under the age of 18, we will delete it in accordance with applicable law.
11. Links to Other Sites.
Our Websites may contain links to other sites. Please be aware that we are not responsible for the content, privacy practices, advertising, or products of any linked sites that we do not control. We encourage our users to be aware when they leave our Services and to read the privacy statements of any other linked sites that collect Personal Information.
12. Changes to Our Privacy Policy.
We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make update this Privacy Policy, we will update the Effective Date. If we make material changes to this Privacy Policy, we will notify you as required by applicable law. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
